What is COIDA?

The Compensation for Occupational Injuries and Diseases Act (COIDA) is South Africa’s key legislation for workplace injury and disease compensation. Enacted in 1993, COIDA ensures employees receive no-fault compensation for work-related injuries, occupational diseases, or death, while protecting employers from civil lawsuits.

Who is Covered by COIDA?

COIDA applies to most employees in South Africa, including:

  • Full-time and part-time workers

  • Casual and foreign workers

  • Domestic workers (since the 2022 amendment)

Exclusions include independent contractors, SANDF and SAPS members, and certain volunteers.

Benefits of COIDA

The Compensation Fund, funded by employer contributions, provides:

  • Medical Expenses: Coverage for up to two years.

  • Temporary Disability: 75% of earnings for up to three months.

  • Permanent Disability: Lump sums (≤30% disability) or pensions (>30% disability).

  • Death Benefits: Funeral costs and support for dependants.

Employer Responsibilities

Employers must:

  • Register with the Compensation Fund within seven days of hiring.

  • Pay annual assessments based on payroll.

  • Report injuries within seven days and diseases within 14 days.

How to File a COIDA Claim

  1. Employee reports the injury or disease to the employer.

  2. Employer submits the claim with medical reports to the Compensation Commissioner.

  3. Claims must be filed within three years (per the 2022 amendment).

COIDA 2022 Amendments

The 2022 amendments expanded COIDA to:

  • Include domestic workers.

  • Offer rehabilitation and psychosocial support.

  • Cover accidents during work-related transport or training.

  • Extend the claim prescription period to three years.
